On 12 July 2005, the European Court passed a judgement on the validity of the latest European Directive on Food Supplements. Given the fact that this Directive was due to become effective from 1 August, the judgement came very late in the day. The remarkable feature was that the European Court had implemented in a most unusual way the advice received from the Court’s leading advisor, Advocate General Geelhoed, on 5 April 2005. It is now clear that the legislation will become effective on 1 August. The law retains the principles of a positive list, and of safety files. In the Netherlands and in a small number of other European countries, special provisions have been awarded to the government for those substances for which a safety file has been submitted. This has the following consequences for the Plantina products:
  • The formula for Plantina Vitamin C 1000 mg remains unaltered.
  • For the Plantina Multi and Plantina Multi Junior products, all active substances could be retained, and their dosages. The only alteration that had to be made related to the compounds of certain minerals. In the new formula, vanadium is combined with sulphate (previously: ammonium vanadate), borium is included as sodium borate (previously: borium citrate), manganese is combined with gluconate (previously: manganese lactate) and strontium is combined with hydrogen citrate (previously: strontium lactate). Vitamin K1 has also been added to the formula, with a dosage of 50 micrograms.
Labelling rules have also been tightened up. As a consequence, during the first week of August, we altered all labels to comply fully with the new rules, and in the second week of August we were able to supply our products fully in line with EU legislation.

What does it mean for you?

Businesses like The Ortho Company, and wholesalers, had to come up with new products by 1 August. This also applied to Plantina products. However, there is only one thing that is relevant to you, namely if you still have products containing the old formula on your shelves, you are permitted to continue selling them, until your stocks are used up.
